Terms of Use
Version 2026-10-28
DRAFT — NOT YET REVIEWED BY A LAWYER. Items in [square brackets] must be filled in before release.
These Terms of Use (the "Terms") are a licence agreement between you and [OPERATOR LEGAL NAME] ("we", "us"), the developer of Raice (the "App"). They cover the App, its AI coach, and the online service behind it (together, the "Service"). They include how we collect and use your personal and health data. By creating an account, you agree to these Terms. Separately, you also give your consent to how we process your health data (see section 7). If you don't agree, don't create an account or use the Service.
1. What Raice is
Raice is a running app. It builds training plans, imports and records your runs, analyses them, and gives you coaching through an AI coach. It can also send planned workouts to compatible watches and services (for example Apple Watch, Garmin, and Intervals.icu).
2. Your health and safety — please read
- Not medical advice. Raice gives general fitness information. It is not a doctor, physiotherapist or other health professional, and it does not diagnose, treat or prevent any medical condition. Never ignore professional medical advice, or delay seeking it, because of something the App says.
- Check with a doctor first. Talk to a doctor before starting or changing an exercise programme, especially if you are pregnant, have a heart condition, high blood pressure, diabetes, asthma, a past or current injury, or any other medical condition, take medication, or have been inactive for a long time.
- Listen to your body. Stop exercising straight away and get medical help if you feel chest pain or pressure, severe shortness of breath, dizziness, faintness, an irregular heartbeat, or sharp or worsening pain. A training plan is a suggestion, never an instruction to push through pain, illness or injury.
- Plans are general. Plans and paces are worked out from the information you give us and the activities we receive. They can't account for everything about your health, fitness or circumstances, and they may be wrong for you. You decide what is safe for you to do.
- AI can be wrong. The AI coach generates its answers automatically. They may be inaccurate, incomplete or inappropriate. Use your own judgement, and don't rely on the coach for anything medical or for anything where safety is at stake.
- Measurements are estimates. Distance, pace, heart rate, cadence and other figures come from your phone, watch and other devices. They may be inaccurate and are not medical measurements.
- Run safely. You are responsible for where, when and how you exercise. Watch for traffic and other hazards, follow local laws, dress for the weather, and don't use the App in a way that distracts you from your surroundings. Weather information in the App is approximate and may be out of date.
- Your risk. Running and other exercise carry an inherent risk of injury, illness and, rarely, death. To the extent the law allows, you take on these risks yourself when you follow a plan or any advice from the Service.
3. Who can use Raice
You must be at least [16] years old to create an account. By creating one, you confirm you are. You need to give us accurate information and keep your password secure. You are responsible for what happens under your account. Tell us at [CONTACT EMAIL] if you think someone else has accessed it.
4. Your licence to use the App
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on Apple-branded devices you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions. You must not:
- copy, modify, reverse engineer or redistribute the App, except where the law allows this despite these Terms;
- use the Service to break the law or infringe anyone's rights;
- try to get into accounts or data that aren't yours, or disrupt or overload the Service;
- use automated means to scrape the Service or harvest its data;
- use the AI coach to generate unlawful, harmful or abusive content, or try to get around its limits.
We own the App and the Service, including its training methods, software and content. These Terms don't transfer any of that to you.
5. Your content
You keep ownership of what you put into Raice: your activities, notes, chat messages and profile (your "Content"). You give us permission to store, process and display your Content only to run and improve the Service for you, as described in the privacy terms below. You are responsible for your Content and must have the right to share it.
6. Privacy: what data we collect
We collect only what we need to provide the Service:
- Account data: your email address, your display name, and your password, which we store only as a one-way hash. If you use Sign in with Apple, we store the identifier Apple gives us for your account.
- Profile and fitness data you give us: optionally your sex and date of birth, plus your running experience, typical weekly distance and pace, recent race results, whether you have a history of injury, your goals, your preferred units and your coach's tone.
- Health and workout data: if you allow it in Apple Health, we read your running workouts and related data: distance, duration, pace, heart rate, cadence, stride length, steps, active energy, elevation and GPS route. Runs you record in the App, and activity files you import from Garmin, contain the same kinds of data.
- Location: while you record a run, the App uses your location, including in the background, to track the route. We store the route with the activity.
- What you write: messages to the AI coach, notes on your activities and plans, and feedback you send us.
- Connected services: if you connect Intervals.icu, we store the access credentials you give us so we can send workouts there.
- Technical data: your time zone, and basic server logs (such as IP address, request times and errors) that we keep to run and secure the Service.
We don't use advertising trackers, and we don't track you across other companies' apps or websites.
7. Privacy: how we use your data
We use your data to:
- create your account, sign you in and send you service emails (such as email verification and password resets);
- generate and adjust your training plans and analyse your runs;
- power the AI coach's analysis, chat, weekly updates and plan suggestions;
- sync workouts with the devices and services you connect;
- add weather conditions to your activities;
- keep the Service secure, fix problems, and prevent abuse (for example, daily limits on AI use);
- meet our legal obligations.
Health data and your consent. Your workouts, heart rate, routes, injury history and other health data are processed only with your explicit consent. You give it separately from agreeing to these Terms when you create your account. Because Raice's plans and coaching are built from this data, we can't create an account without that consent. With it, we use your health data only to provide and improve your training and coaching, which includes sending it to our AI model provider (section 8). We never use it for advertising or marketing, and we never sell it. You can withdraw your consent at any time (section 10).
[If you are in the UK or EU: we rely on your consent for health data (which you can withdraw at any time), on performing our contract with you for your other account and training data, and on our legitimate interests for security and fixing problems. Confirm and adjust this paragraph with legal advice.]
8. Privacy: who we share data with
We never sell your personal data. We share it only with service providers that help us run the Service, and only as much as each needs:
- An AI model provider: to answer you, the AI coach sends your profile, training plan, relevant activities and your messages to a third-party AI model provider. We do this only with the consent you give when you create your account. The provider uses the data only to generate the coach's replies, and is not permitted to use it to train its models. [Confirm against the current AI provider's terms and data-retention settings.]
- A weather data provider: to look up the weather for an activity, we send it the approximate start location and time of the activity, not your name or account details.
- An email delivery service: to send service emails to your address.
- A cloud hosting provider: which runs our servers and database in [REGION].
- Services you choose to connect, such as Intervals.icu or Garmin: we send them the workouts you ask us to send. Their own terms and privacy policies apply to what they do with it.
- Apple: if you use Sign in with Apple, Apple Health or Apple Watch, Apple handles that data under its own privacy policy.
We require these providers to use your data only to provide their service to us, and to protect it at least as well as these Terms do.
We may also disclose data if the law requires it, to protect someone's safety, or as part of a sale or reorganisation of the Service. If the Service is sold, these privacy terms (or ones at least as protective) continue to apply.
Some of these providers may process data outside your country. Where the law requires it, we use appropriate safeguards, such as standard contractual clauses.
9. Privacy: storage, security and keeping data
We store your data on our servers and keep a cached copy on your phone so the App works offline. Your sign-in tokens are kept in the iOS Keychain. Data travels to and from our servers encrypted (HTTPS). No system is perfectly secure, but we take reasonable steps to protect your data and limit who can access it.
We keep your data for as long as you have an account. When you delete your account, we delete your account, profile, plans, activities and coach conversations from our systems within [30] days, apart from anything we must keep by law. Backups are overwritten on their normal cycle. Deleting the App from your phone removes the on-device copy but doesn't delete your account.
10. Privacy: your rights and choices
- Apple Health and location: you can turn off Raice's access at any time in iOS Settings. The App will keep working, with fewer features.
- Withdrawing consent: you can withdraw your consent to health-data processing at any time by emailing [PRIVACY EMAIL] or deleting your account. Withdrawing doesn't affect processing that took place before. Because the Service depends on this data, withdrawing it means closing your account, and we then delete your data as described in section 9.
- Access, correction and deletion: you can see and edit most of your data in the App. To get a copy of your data, correct it or delete your account, email [PRIVACY EMAIL]. [Add "or use Settings → Delete Account" once in-app account deletion ships.]
- Depending on where you live (for example in the UK, the EU or California), you may also have the right to object to or restrict how we use your data, to move it to another service, and to withdraw consent. You also have the right to complain to your local data protection authority. We won't treat you differently for using these rights.
- Children: Raice is not for anyone under [16]. If we learn we have data from a child, we delete it.
11. Third-party services
The Service works with services we don't control, such as Apple Health, Apple Watch, Garmin, Intervals.icu and weather providers. Your use of them is covered by their own terms. We aren't responsible for how they work, whether they are available, or how accurate their data is.
12. Changes and availability
We may change, pause or stop parts of the Service, including the AI coach and any usage limits. We may update these Terms. If a change is significant, we will tell you in the App or by email before it takes effect and may ask you to agree again. If you keep using the Service after a change takes effect, you accept the updated Terms.
13. Ending your account
You can stop using Raice and delete your account at any time. We may suspend or close your account if you seriously or repeatedly break these Terms, or if the law requires us to. Sections 2, 4 (ownership), 14, 15 and 17 continue after your account ends.
14. Disclaimers
To the extent the law allows, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy and uninterrupted availability. We don't promise any particular fitness, performance or race result.
15. Limitation of liability
To the extent the law allows, we are not liable for any indirect, incidental, special or consequential loss, or for loss of data, profits or goodwill. Our total liability to you for anything arising from the Service is limited to the greater of the amount you paid us in the 12 months before the claim and [AMOUNT]. Nothing in these Terms limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that can't be limited by law. Nothing in them affects your statutory rights as a consumer.
16. Apple-specific terms
- These Terms are between you and us, not Apple. We, not Apple, are solely responsible for the App and its content.
- Apple has no obligation to provide maintenance or support for the App.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App, if any. To the extent the law allows, Apple has no other warranty obligation for the App.
- We, not Apple, are responsible for handling any claims relating to the App, including product liability claims, claims that the App fails to meet a legal or regulatory requirement, and consumer protection or privacy claims.
- We, not Apple, are responsible for investigating, defending, settling and discharging any claim that the App or your use of it infringes someone else's intellectual property rights.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, may enforce them against you.
17. General
These Terms are governed by the laws of [JURISDICTION]. Disputes go to the courts of [JURISDICTION], unless your local consumer law gives you the right to bring a claim where you live. If any part of these Terms is found unenforceable, the rest still applies. If we don't enforce a right straight away, we don't give it up. You may not transfer these Terms to anyone else. We may transfer them as part of a sale or reorganisation of the Service.
